# Santa’s Grotto Ireland – Booking Terms and Conditions

These Terms and Conditions apply to bookings for Santa’s Grotto Ireland. Please read them carefully before completing your purchase.
Santa’s Grotto Ireland is owned and operated by Thomas Joseph Delany, trading as Santa’s Grotto Ireland, of 30 Newlands Road, Clondalkin, Dublin 22, D22 HR12, Ireland.

## 1. Making a Booking
**1.1.** A booking is confirmed once payment has been successfully processed and a booking confirmation has been issued.
**1.2.** The person making the booking must be at least 18 years old and is responsible for:
* Ensuring that all booking information is accurate;
* Informing everyone included in the booking of these Terms and Conditions;
* Ensuring that the correct ticket type is purchased for each guest; and
* Supervising all children included in the booking.
**1.3.** Please check your confirmation immediately and contact us promptly if any information is incorrect.
**1.4.** All bookings are subject to availability. A selected date or time is not secured until payment has been completed and confirmation has been issued.
## 2. Tickets and Prices
**2.1.** Ticket prices are displayed during the booking process. Any compulsory booking or transaction fee will be shown before payment is completed.
**2.2.** Every person attending, including adults and babies, must have the appropriate ticket.
**2.3.** Children’s and baby tickets are based on the child’s age on the date of the visit.
**2.4.** A gift is included only with a ticket specifically described as including a gift. Adult tickets, as well as tickets described as “without gift”, do not include a gift.
**2.5.** Gifts may differ according to age, availability and stock levels. Images used in advertising are illustrative, and we may provide a reasonably equivalent alternative where necessary.
**2.6.** Customers are responsible for checking that the selected ticket types, quantities, date and time are correct before paying.
**2.7.** Tickets must not be resold for profit or used for unauthorised commercial purposes.
## 3. Payment
**3.1.** Full payment is required when making an online booking.
**3.2.** Online card payments are securely processed by Stripe. We do not receive or store customers’ complete payment-card details. Stripe processes payment information under its own privacy and security policies.
**3.3.** Additional tickets, photographs and other items may be purchased on-site, subject to availability. Payment must be completed before admission or before the relevant item is provided.
**3.4.** On-site card payments are securely processed by SumUp. We do not receive or store customers’ complete payment-card details. SumUp processes payment information under its own privacy and security policies.
**3.5.** On-site payments may be made by card or cash. Available payment methods may be subject to change, and customers paying with cash are encouraged to bring the correct amount where possible.
**3.6.** If a payment is declined, reversed or otherwise not completed, the related booking or purchase may be refused or cancelled.
## 4. Customer Cancellations and Booking Changes
**4.1.** Tickets are non-refundable where the customer cancels, no longer wishes to attend or is unable to attend.
**4.2.** Customers may request one change to their booking, including moving to another available date or time, by contacting us at least 24 hours before the scheduled visit.
**4.3.** All booking changes are subject to availability and cannot be guaranteed.
**4.4.** Guests may be added to or removed from a booking by contacting us at least 24 hours before the scheduled visit. Removing a guest does not entitle the customer to a refund.
**4.5.** If an additional guest arrives without having been added beforehand, we will make reasonable efforts to accommodate them. Admission will be subject to capacity, availability and payment of the applicable ticket price. Admission cannot be guaranteed.
**4.6.** Changes requested less than 24 hours before the scheduled visit may be accommodated at our discretion but are not guaranteed.
**4.7.** Failure to attend, or arriving too late for us to accommodate the booking, does not entitle the customer to a refund or transfer.
**4.8.** As the booking relates to a leisure activity supplied on a specific date or during a specific period, the statutory 14-day cancellation right that applies to many online purchases may not apply. Nothing in these Terms affects any rights that a customer has under applicable consumer law.
## 5. Arrival and Admission
**5.1.** Customers should arrive no earlier than 10 minutes before their booked time.
**5.2.** Entry will not be permitted more than 10 minutes before the booked time.
**5.3.** Customers should have their booking confirmation available on a mobile device or in printed form when they arrive.
**5.4.** Customers must arrive promptly. We will make reasonable efforts to accommodate late arrivals, but admission at a later time and delivery of the complete experience cannot be guaranteed.
**5.5.** Visits operate according to timed bookings. Short delays may occasionally occur during busy periods because each family’s visit is managed with care. A reasonable delay does not entitle the customer to a refund.
**5.6.** We may refuse admission where:
* A valid booking cannot be confirmed;
* The appropriate ticket has not been purchased;
* Admission would exceed safe capacity;
* A guest behaves in a threatening, abusive, unsafe or seriously disruptive manner; or
* A guest refuses to follow reasonable instructions from staff or shopping-centre management.
**5.7.** No refund will be provided where admission is reasonably refused because of a customer’s conduct or failure to comply with these Terms.
## 6. Children and Supervision
**6.1.** Children must remain under the supervision of a responsible adult at all times.
**6.2.** We do not provide childcare, and children must not be left unattended with Santa, an elf, a photographer or any other member of staff.
**6.3.** Parents and guardians are responsible for deciding whether the experience is suitable for their child.

We will make reasonable efforts to assist, but specific adjustments should be agreed in advance where possible. Please include your booking reference number, the date and time of your visit and your surname when emailing us.
## 7. The Experience
**7.1.** The experience includes a personal, private visit with Santa Claus, interaction with Santa’s elves, festive scenery and the opportunity to purchase photographs taken by our professional photographers during your visit.
**7.2.** Characters, performers, decorations, layouts, gifts and individual elements of the experience may change where reasonably necessary. However, we always aim to provide the same exceptional experience to every visiting family.
**7.3.** We cannot guarantee that a particular performer will appear as Santa or as any other character.
**7.4.** The advertised experience may be adjusted for safety, operational or accessibility reasons, or because of circumstances outside our reasonable control. Any replacement element will, where reasonably possible, be of an equivalent nature or value.
**7.5.** Customers must follow all reasonable safety instructions given by our staff and by The Mill Shopping Centre.
## 8. Photography
**8.1.** Professional photographs may be taken during the Santa visit and purchased in advance or during your visit. There is no obligation to purchase photographs. Photograph files are retained for up to 30 days after the event’s seasonal closure, as explained in our Privacy Notice.
**8.2.** Any applicable photograph packages and prices will be displayed or explained before purchase.
**8.3.** Customers should inspect printed photographs before leaving where reasonably possible. If a purchased product is faulty or does not match what was ordered, please notify staff promptly so that we can provide an appropriate remedy.
**8.4.** Personal photography or video recording is restricted inside Santa’s room to prevent disruption to the experience and allow our photographers to work safely. Customers must follow staff instructions.
**8.5.** Customers must not photograph or record staff, other families or children without permission.
**8.6.** Photographs of customers or children will not be used by us for advertising, social media or other promotional purposes without separate appropriate permission.

## 9. Behaviour and Safety
**9.1.** We want every family to enjoy a safe and welcoming experience. Abusive, threatening, discriminatory, dangerous or seriously disruptive behaviour will not be tolerated.
**9.2.** We may remove any person whose behaviour places another guest, staff member or the event at risk or materially disrupts the experience.
**9.3.** Children must not climb on decorations, barriers, furniture, electrical equipment or set pieces.
**9.4.** Customers are responsible for loss or damage caused by their deliberate, reckless or negligent conduct.
**9.5.** Smoking, vaping, illegal substances and the consumption of alcohol are not permitted within the Santa’s Grotto Ireland event area.
## 10. Accessibility and Medical Requirements

**10.2.** We will make reasonable efforts to accommodate guests and provide reasonable assistance where possible.
**10.3.** Customers remain responsible for bringing any medication, mobility aid, personal assistant or other support they require.
**10.4.** Nothing in these Terms limits any obligation we have under applicable equality or disability legislation.
## 11. Cancellation or Changes by Us
**11.1.** We may need to cancel, reschedule or materially change a session because of illness, staff availability, venue issues, safety concerns, extreme weather, government restrictions or other circumstances outside our reasonable control.
**11.2.** If we cancel a booking and cannot provide the booked experience, customers will be offered:
* A transfer to another available date or time; or
* A refund of the amount paid for the affected booking.
**11.3.** If we make a significant change that materially alters the booked experience, we will contact affected customers and provide an appropriate remedy in accordance with applicable consumer law.
**11.4.** We are not responsible for reasonable minor changes that do not materially affect the overall experience.
**11.5.** We are not responsible for a customer’s separate expenses, such as travel, accommodation or parking, except where liability cannot lawfully be excluded.
## 12. Refunds
**12.1.** Where a refund is due, it will normally be returned using the original payment method.
**12.2.** Refund processing times may depend on the customer’s bank or payment provider.
**12.3.** Nothing in these Terms excludes or restricts any refund, repair, repeat performance, price reduction or other remedy to which a customer is legally entitled.
## 13. Personal Information
**13.1.** We collect and use personal information to administer bookings, process payments, communicate with customers, deliver the experience and comply with our legal obligations.
**13.2.** Booking information may be processed by third-party providers, including our booking platform and payment providers.
**13.3.** Our handling of personal information is explained in our separate Privacy Notice.
**13.4.** Customers must provide accurate contact details so that we can send booking information and notify them of important changes.
## 14. Liability
**14.1.** Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.
**14.2.** We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
**14.3.** We are not responsible for losses that are not foreseeable, arise from information incorrectly supplied by the customer, or result from the customer’s failure to follow reasonable instructions.
**14.4.** We are not responsible for personal belongings that are lost, stolen or damaged unless this results from our negligence or another matter for which we are legally responsible.
**14.5.** These Terms do not affect a customer’s statutory rights.
## 15. Complaints
**15.1.** If a problem arises during the visit, please bring it to the attention of a staff member as soon as possible so that we have an opportunity to address it.

**15.3.** We will review complaints fairly and respond within a reasonable period.
## 16. General Terms
**16.1.** If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
**16.2.** A delay by us in enforcing any provision does not waive our right to enforce it later.
**16.3.** These Terms, together with the booking confirmation, Privacy Notice and any policies expressly referred to during checkout, form the agreement between the customer and us.
**16.4.** No person other than the customer and the event operator has any right to enforce these Terms, except where the law provides otherwise.
**16.5.** These Terms are governed by Irish law. Customers retain any mandatory consumer protections and may bring proceedings before any court that has jurisdiction under applicable law.

Our booking service is provided through SantaBooker. Personal information entered during the booking process may be processed through SantaBooker to create and administer the booking.
Online card payments are processed by Stripe. We do not receive or store customers’ complete payment-card details.
On-site card payments are processed by SumUp. We do not receive or store customers’ complete payment-card details.
SantaBooker, Stripe and SumUp process information in accordance with their respective terms and privacy notices. They may collect information directly from customers when their services are used.
## 7. Photography During the Experience
### Customer Photographs
Photographs may be taken during the Santa visit so that families can view and, if they wish, purchase them.
There is no obligation to purchase a photograph. If a family does not want an official photograph taken, they should tell a staff member or photographer before entering Santa’s room.
Photographs taken for viewing or purchase will not automatically be used for advertising or promotional purposes.
### Promotional Photographs and Videos
We may ask selected families whether they are willing to let us use particular photographs or videos to promote Santa’s Grotto Ireland.
Promotional use may include:
* Our website and booking pages;
* Our social-media accounts;
* Online and printed advertisements;
* Posters, flyers and other printed materials;
* Press or public-relations material; and
* Promotion of future Santa’s Grotto Ireland events.
Before using an identifiable child’s image for these purposes, we will obtain separate permission from the child’s parent or legal guardian. We will explain the intended uses when seeking permission.
Promotional consent is voluntary. Refusing permission will not affect the family’s booking, treatment, photographs or experience.

We will stop new promotional use and remove material under our control where reasonably practicable. * Stripe and SumUp, as our payment providers;

* The venue or shopping-centre management where reasonably necessary for safety, security or event operations;
* Public authorities, regulators or emergency services where required by law or necessary to protect someone’s safety; and
* A purchaser or successor if our business is transferred, subject to appropriate safeguards.
We require service providers acting on our behalf to protect personal information and use it only for authorised purposes.
## 9. International Transfers
Some of our service providers may process personal information outside Ireland or the European Economic Area.
Where this occurs, we will take reasonable steps to ensure that an appropriate legal transfer mechanism and safeguards are in place, such as an adequacy decision or approved contractual protections.

* **Routine enquiries and correspondence:** generally up to 12 months after the matter is closed;
* **Unpurchased customer photographs:** generally deleted within 30 days after the event’s seasonal closure;
* **Purchased photograph files:** generally retained for up to 30 days after the event’s seasonal closure to allow us to address quality or replacement issues;
* **Accessibility or support information:** deleted within 30 days after the event’s seasonal closure unless it forms part of an incident, complaint or legal record;
* **Promotional photographs and consent records:** retained for up to three years, or until consent is withdrawn, unless continued retention is reasonably necessary to document previous lawful use;
* **Marketing contact information:** retained until consent is withdrawn, the recipient unsubscribes or the information is no longer reasonably required; and
* **Accident, incident, complaint or legal records:** retained for the period reasonably necessary to meet legal, insurance and dispute-resolution requirements.
Information may be retained for a longer period where required by law or where reasonably necessary in connection with a complaint, investigation or legal claim.
## 11. Marketing Communications
We will send optional promotional emails or messages only where we have an appropriate lawful basis.
Where marketing is based on consent, customers may unsubscribe at any time by:
